Terms of Service.

Effective Date: March 1, 2026

1. Acceptance of Terms

By accessing or using OpenInsure's services, you agree to be bound by these Terms of Service. If you are using the services on behalf of an organization, you represent that you have authority to bind that organization to these terms.

2. Services

OpenInsure provides a policy administration platform including rating engines, claims management, billing, and related insurance infrastructure services. Services are provided on a subscription basis as described in your order agreement.

3. Your Responsibilities

You are responsible for maintaining the confidentiality of your account credentials, ensuring that your use complies with applicable insurance regulations, and the accuracy of data you submit to the platform. You agree not to use the services for any unlawful purpose.

4. Data Ownership

You retain all rights to your data. OpenInsure does not claim ownership of any policy, claims, or financial data processed through the platform. Upon termination, you may export your data within 90 days.

5. Service Level Agreement

OpenInsure commits to 99.95% uptime for production API endpoints. Scheduled maintenance windows are communicated 72 hours in advance. Service credits are issued for downtime exceeding the SLA as described in your order agreement.

6. Licensing

The OpenInsure platform is available under the Business Source License 1.1 (BUSL-1.1). The source code is viewable, but production use requires a valid commercial license. After the change date, the code converts to an open-source license.

7. Limitation of Liability

To the maximum extent permitted by law, OpenInsure's total liability shall not exceed the fees paid by you in the 12 months preceding the claim. OpenInsure shall not be liable for any indirect, incidental, or consequential damages.

8. Governing Law

These terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.
